Went to see Built to Spill at Lupos in Providence with Chris and Steve. Man, what a great live band! It was nice to get out and get drunk again (mmmmm,,,, Capt'n and coke). Been awhile. It was also the first show I've been to in awhile that I haven't felt like 90 years old at. Good mix in the age of the crowd. Or maybe I'm just becoming less sensative to the fact that I'm getting real old....

My freshman year of college, I discovered Yo La Tengo by reading a book catalog (Ziesing's) with a little article by Lucius Shepard in it in which Lucius listed a bunch of bands he was digging at the time. I liked the name, so I bought President/New Wave Hot Dogs and have been devoted to their music ever since. So when Lucius talks, I listen. Here's an old article I stumbled across where Lucius talks up Paul Mann's novels.

Back to MP3s and Napster! As much as I hate Limp Bizkit I have to respect them for this.

16:37 mega

Update to my spyware post yesterday. These are most of the programs that may load the offending software onto your computer. This sort of subversive "spying" is outragous. There is no option to "opt out" or even any real explanation of the nature of there intrusion. In fact they hide the spyware deep in your system. On a positive note I did hear that once this was made public a few months ago the spyware part of these programs have mysteriously stopped being part of the download for alot of this software. Still it's better to be safe....

I hadn't realized that Metallica invoked the RICO act in their suit against Napster and users of Napster. Really good way to treat fans of your music. Sue 'em. When sales of music actually go down then I'll be against MP3 trading but the evidence is to the contrary. Since CD burners and MP3s have become basically mainstream sales in the music industry continue to grow. Sort of deflates Metallica's and Dr Dre's contention that they're losing money ($100,000 dollars a song according to the suits).

I think this news is ancient, or maybe it's false or an urban legend, I wish I had a web page to link to about this, maybe I'm hypocritically ripping to shreds the concept of privacy right now... But Dan Bunton, the creator of the games MULE and Global Conquest, is now Danielle Berry. William Mataga, the creator of the game Shamus, is now Cathryn. And Jay Fenton, a creator of Gorf, and Macromedia Director, now goes by the name Jamie Faye. What is it about designing software that makes people want to change their gender? When I find out, so will you.

22:54 N

Andre Young, aka Dr Dre, ups the ante in his suit against napster. He's apparently targeting users of the software now and plans to name several students specifically. Maybe he should target the cassete tape next. I hear you can copy music onto that too.....

I have seen almost every episode of Law and Order at least 5 times (minimum) now except for the newest season of course. If I could I would own the whole series on DVD. It's got some sort of unnatural control over me. I never get tired of it. I think I need help.....

21:52 mega

Like I said I think your basic assumptions are incorrect. You assume that the plan this company is trying for will in fact come to pass. I don't believe it will. Fact is companies have ideas they try to implement all the time and when they take them to market they flat out don't work and I believe most of what this company intends as put forth by the source you gave will just not "float". I'll tell you right now that if any ISP tries to force ads on people they will lose customers: lower costing or not. End of story. So using an example of listening to one minute of commercials before making a phone call carries no weight for me. Also there is enough competition in the ISP market that any "non-tracking" ISP will probably be about what I pay now (if not less in the months it would take to implement this). Furthermore the second they try to force parents with underage kids to give "permission" to track their kids or they'll cut their internet service they will bring the wrath of the government down on themselves because that's a hot button issue now. If there was a monopoly in ISP services then I would worry but as it stands I actually believe the market can handle this. So don't get me wrong. I don't like the idea of being tracked blatantly like that and if I thought it was going to be an issue then I would be upset. I appreciate that people like yourself will inform me as to what ISP buys into this service and I will avoid them. So I can continue to surf the web in the unsecure and easily trackable manner I do right now.
I also don't think comparing the internet to the telephone is a good analogy. Going from webpage to webpage is more like going from yard to yard in a neighborhood. People can see you enter. Watch how long you stay and then watch you leave. And anyone who wants to and takes the time can watch you meander around that neighborhood to see where you go. That's just the way the internet works and will work unless they decide to change the whole structure of it from the ground up. There is and never has been much, if any, privacy in cyberspace. So don't kid yourself- the "phone" is already tapped. Always has been.

20:57 mega

To me, this is akin to having all of our telephones illegally wiretapped, and being forced to listen to one minute of ads before being able to dial the phone each and every time. And oh, but you can avoid this if you can afford to give the phone company more money, so they can recoup the "loss" they're incurring for not being able to have data on you to sell...
If the expectations of privacy online among people as intelligent as you two are really this low, then the Power Elite is even farther along than I thought in "preparing" us for Big Brother.

20:01 N

I can't presume to speak for all those not enraged, but I will address a couple of the points raised below... First, are you implying there is somewhere one could go to see pictures of pretty young girls on the internet?! I'm shocked, shocked I say! C-Dog turns up nose and gets down to the business of reasonable disagreement...
1. Comes back to expectation of privacy. If I used the pc at the public library to surf porn sites (rumor has it those are on the internet too, the horror!) it would be foolish of me to think that the next person on might not have the ability to hit the Back button after I got off, or if they were the snoopy type to look at the browser's history folder, wouldn't it? Same principle would apply to any shared pc, if I went somewhere, I'd expect there to be detectable trace of it. Consequently, I wouldn't go anywhere I was concerned about their being ramifications to visiting. Same as if I were concerned about downloading something from an unknown/untrusted location: don't want to risk virus, don't download the file. Plus, I'm guessing that lots of families have children in the house that use the same pc as the parents. If targeted advertising becomes prevalent, that sort of thing will put lots of kids at risk of seeing pornographic material, it won't happen because ISPs know they'll lose every client that has a family if they let those sorts of advertisers have free reign to advertise anywhere. (That's sheer speculation, of course, but I'm guessing those advertisers will remain marginalised by major media outlets.)
2. In that scenario, I'm sure concerned consumers will flock to ISPs that offer privacy, even if it means paying a little more. The internet is a business, business people are going to try and make money off it any sleazey way they can, just like anything else. The government will either regulate them or people will find another way to use the services they want. I don't want to pay more for privacy on an ISP, but that's because I can live with being tracked and paying rock-bottom for access. Again, because personally I don't care if I'm tracked and have to look at ads. It's a nuisance, but one I can live with.
3. Again, I don't expect that where I surf is top-secret, classified information. I fully expect the business people who run ISPs to track trends and target marketing to me. I'm not having t-shirts printed with my credit report on 'em to hand out at dinner parties, but I know that all sorts of people and businesses who shouldn't do have access to it. If I feel like I'm getting fucked over on account of someone looking at it that shouldn't, you can bet me and the meanest, nastiest lawyer I can find ("Um, hi Dat. You, uh, wanna do some pro bono work?") will be serving some papers of our own. Way of the fucking world, y'know? I totally agree, some things should be private, but they never will be. Just about anyone who works for a credit card company, bank, car dealership, or whatever can look at anyone's credit report whenever they want. Janitor to CEO, the information is there for the taking and almost totally insecure. But, if someone looks at it who shouldn't, they face serious penalties. My point: don't kid yourself for a second that your credit report or anything else will ever be private.
4. There are probably photos of both of us in some file somewhere from anti-Gulf War demonstrations in DC or the Earth Day protests in NYC oh those many years ago. I'm just not worried about it. When the jack-booted polizei come for me, they're gonna get have to deal with my C-Dog-Fu Martial Arts techniques. (I think I just gave myself a groin pull kicking an imaginary storm trooper in the neck. Ow. I should get one of those web-cams, people would get a kick out of me.)

Bottom line, don't think that because I'm not worried, I'm not glad we gots folks out there spreading the word and making sure this shit doesn't go down in the dark of night. Fight on, brother.

17:57 c-dog

You realize they can and do already track you, right? I mean especially now that you have DSL. Remember that free service that you were using to track info for your website? Well the versions they charge for already has all kinds of info on you (your IP anyway). Personally I'm with C-Dog. I have little expectation of privacy while on the web. And if I wanted supreme privacy then there will always be hacks out there and ways around this kind of stuff because hackers live to circumvent this kind of thing. Also with the competitive nature of the ISP industry there will always be services that can use NOT being part of this as a selling point. Honestly any service that opts for a two tier price structure or forcing ads on its customers is shooting themselves in the foot and other ISPs will be glad to take their customers at normal prices. I don't think things will get as dire as you predict mainly because I feel the assumptions you are basing your predictions on are fundamentaly flawed. I'd spend more energy railing against the personal info that is traded everyday in the "real world". Info like criminal records, debt, etc. are bought and sold ever day to a myriad of agencies. None of this is controlled so if any info is wrong it's near impossible to fix it. That's an issue. Whether I surf porn or not isn't so much for me.
Having said that I would try to opt out of any scheme like this and would only buy into an ISP that would be clear of it. Then again I pretty much surf knowing that it's possible for all my movements to be tracked right now so knowing a company plans to make cash off it doesn't surprise or alarm me.

17:33 mega

To those not enraged by Predictive Networks:
*1. Say for example that someone is using the same computer as their mother or children. They go to a site, wittingly or unwittingly, with pictures of young females. That gets tracked. Now the advertisers know what the user of that ISP account likes. The next time Mom or Little Joey logs on, she's inundated with porn ads. That's not what I call that "choosing what one wants to look at for internet access."
*2. The paper states that if you do not agree to sacrifice your privacy and be tracked and inundated with ads, your ISP will refuse you service and kick you off, or charge you more for your ISP account. This is fascist. "Well, we already know when we buy a television that we can't use it without seeing commercials." What if you couldn't own a television at all without submitting- no Playstation without ads in the upper left corner. What if you weren't allowed to buy a car unless it looked like a Nascar car with ads all over it? What if the ads were for cigarette makers, environmental polluters? And then when you scrape an offending ad off, the cops stop you and impound your car?
*3. Credit reports, which were originally just for use by banks and credit card companies, are available via court orders all the time. Would you like your ISP subpoenaed? Want where you surf to be available via court order? If you're in the middle of a divorce fighting for custody of your children- don't dare go online anymore.
*4. Just in the simple matter of surfing to find my Beyond Vegetarianism link of a couple days ago, I briefly visited a very militant animal rights site. It's as if I went to the library to learn something about tofu, and now there's a page in my FBI file because a surveillance camera caught me near a questionable book?
*Bottom Line 1: I don't want more advertising. Spam doesn't make me buy anything either. But it does lessen my experience with the internet and clog up my e-mail. C-Dog, you complain as much as anyone about our Geocities tag in the top right.
*Bottom Line 2: I don't want where I surf tracked. There's no purpose or social redeeming quality except to try to sell me something. So let's fight it. I realize that in my arguments I've extrapolated to a future even more Big Brothery than we have now, but the information is just aching to be abused. Or "mainstreamed." I'm sure insurance companies, etc. would love to know where you surf as well and make decisions based on what they find. And if they don't care where you surf yet, there's companies like Predictive Networks to sell the idea to them.

14:44 N

Watched Elian's cousin get interviewed on NBC news this morning after Elian was removed at gunpoint from the house in Miami: she's kinda nuts. "We didn't know Marshalls were gonna come..." Whatever. Everybody else in the world knew what was coming, weren't they watching the news? "They didn't need guns..." Wish they hadn't, but we all saw the protester who, when interviewed on tv, babbled inanely about " ... you remember Waco? This gonna be another Waco, my friend ..." You gotta take some of soft-skulls at their word and prepare for the worst. "It didn't have to come to this..." No, it didn't. The boy could have been given to his father, his legal and rightful custodian, as soon as was possible. "They aren't human, the people who did this ... Janet Reno has no heart ... they are dogs ..." That's the kind of seige-mentatlity/distorted thinking that head cases indulge in before they do something stupid and monstrous to another human being. Those Marshalls are human beings. Human beings who were given the difficult job of enforcing the rule of law in hostile, potentially dangerous situation. To imply otherwise is to say that they are a legitimate target for violent actions -- that's insanity. I hope the great-uncle and cousin don't have that poor kid's head all screwed up from listening to their self-serving justifications for their immoral behavior.

Re: Privacy Issue Raised in last post.
Having trouble working up rage or concern about tracking. Perhaps because I don't have a high expectation for privacy on the internet. If some corporation decides I fall into their consumer classification "geek" because they were able to determine that the last phrase I entered into a search engine was 'doctor who', and consequently decide to target me with "geek marketing" ... who cares? No matter how much they blink, gyrate, flash or whatever I just don't see the banner ads on websites; they're background noise that gets filtered out. It's not a big deal to me that I have to check and delete unread a half dozen or so advertising emails each time I log on, it's part of the internet hassle/experience. Don't get me wrong, I'm all for privacy and not being hassled by the man, but as long I still get to choose what I want to look at/buy/pay for internet access, then the ubiquitous 'they' can do whatever they want with the data they track about me.

Still thinking about tofu and healthy eating. Here's an interesting site, www.beyondveg.com, and an interesting article in particular: Which Omnivore Diet? The "Omnivorism = Western Diet" Fallacy. Basically, the site makes the case that hominids have been omnivores all the time, and not vegetarian, and that a completely vegetarian or vegan diet is not healthy for most people. But here's the plot twist: what we now call "omnivorous" in the world is not the healthy hominid omnivorous diet. It's not like, "Vegetarianism isn't the perfect human diet, so it's totally debunked ha ha, so go out and have your factory farmed beef and milk!" The perfect hominid diet may include the lean meat and organs of animals as they are found in the wild- and lots of insects and larvae. Found indirectly via Eatonweb.

Review of Current Comics:
Rising Stars #6- The best comic right now.
Earth X #X- I am satisfied with this series. I love the Marvel Universe.
X-Men #101- Currently in a three-issue test run with the return of Chris Claremont. This one's a little convoluted, though.
Two Honorable Mentions:
Orion #1: Walter Simonson writing and drawing, John Workman lettering, together again. I loved their run on Thor, and I don't like Thor. But I despise Kirby's New Gods a hundred times more than I ever did Thor. Can this creative team strike again and make hated characters awesome? I just can't bring myself to buy it.
J.U.D.G.E. Secret Rage #1 & 2: I want to say that I love the look of this comic! Almost like painted photographs. Very cool. This should be among the future looks of comics. I wonder if there's extra work involved? Unfortunately, the impressive Mr. Horn should (a) let someone else do the writing, and (b) get over his Pamela Anderson/breast fetish real fast. This has to be just a rumor. I can't see Square being bought out by Microsoft. Sony wouldn't let that happen. I mean if it did then Sony is sort of dead in the water in a sense in Japan as wherever Final Fantasy goes so goes the Japanese public. Sure the PS2 will still be a hit but their ace in the hole has always been that Square was "squarely" (Ugh!) in their corner. If Microsoft buys out Square they will definitely be a player in the console war and a major threat to Sony. Sony already blinked by adding a modem and harddrive. What'll they do after this news?

I really think that this article debunking the digital divide totally misses the point. It concludes that the digital divide isn't because of race or gender but because of education. Duh. When was this ever denied? Don't we teach and educate and shape the expectations and technological aspirations of minorities and women and the poor differently? Yes. And what's this rhetoric about liberals giving the poor computers at taxpayer expense because now it's a "right"? As more and more of our society goes online and appears only online- then computer ownership becomes a necessity, or you risk falling through the cracks of the society. And simply not everyone at this time can afford or has access to or fully understands a computer and internet access. The telephone is not an adequate analogy, as if the poor just have to wait until the price goes down- because the phone never threatened to incorporate or replace large segments of newspapers, government offices, government forms and paperwork, storefronts, etc. What's wrong with Gore's plan to train people to get into the internet economy? Isn't that a good form of welfare that gets people off welfare? What's this great fantasy about the internet being blind and classless? Isn't all technology that way? A nuclear bomb is blind and classless too. But if the Power Elite have the bomb and you don't... Ugh. Too many problems with this idiotic article.

(And, unlike the password you can settle on and use at every site, your username first choice is always already taken or invalid.) Genius-boy (that's me) finally figured out a way around that little prob. Make your username the reminder question for your password! It's so simple, yet so brilliant. I can't believe it took me five years to think of it.

This may (or may not) be an interesting way to get new music. It may also be a way to swap your perfectly good cd for one some idiot used as a coaster in his dorm room.

I thought pan & scan always meant losing some of the widescreen image, but this ign.com article shows that doesn't always have to be exactly true. (This is my first posting using Blogger's bookmarklet. Pretty neat.)

Do the accusations of abuse make anyone else feel like they're getting smoke blown up their ass? And, cruel as it may be to say, even if there were some truth to it ... does Cuba get to decide which American parents are fit or unfit to raise children? It's not our call. First, the kid goes home with his father. Second, let the Cuban state decide if its citizen is fit to raise the boy. I wonder, all the woman protesting Elian's return to Cuba, if their child were taken by a their spouse to Cuba and the spouse died there, would they expect their child back? I think so. Hypocrites. Cuba vs. the USA should have nothing to do with it. The boy should go home. I don't even care if he wants to go or not, you think he's old enough to decide his custody situation? Bunch of crap, that's all this is.

Sony seems to be running a bit scared here. Throwing on a HD and a modem at the last second. Be interesting to see how much more the PS2 going to cost now. I mean at 300 dollars it was already a bit on the pricy side.

Cool, near simultaneous posting there!

Two interesting DVD related news items here. DVHS doesn't sound like it'll compete with DVD. More capacity is cool but where are the features? And rewind/fast-fowarding just plain sucks. Also the fight against DVD rental pricing continues...

Disney must think Shanghai Noon will do well. There's already talk of a sequel. I'm not crazy about the poster, but the advance buzz is Jackie and Owen Wilson have good on-screen chemistry. Opens the same weekend as MI:2, it'll be interesting to see how much audience it gets.

I was very busy at work today, and I have plans tonight for dinner and to see my friend's band. But both my own website and TC are scheduled to get some quality attention from me this weekend. Just a quickie to post the latest on the Napster front: Metallica sues. This makes me want to think more on my position- I was trying to get the artists on my side vs. Big Music Money. No, I think we're still right. (1) Fans will still pay money, (2) the artists need to get better recording deals with the Corporations, and (3) the recordable cassette tape deck didn't end anybody's money train back then, why should this?

Stan Lee will reinvent the DC Universe. I don't know how to react to this. 25% of me: Blasphemy! Stan Lee IS Marvel. 25%: The DC Universe sucks so bad that even he can't save it- this project will suck. 25%: If anyone could save it, it's Stan Lee. 25%: Stan Lee's prime creative time pre-dates Watergate- this project will suck. Not even a three-issue exploration for me.

18:03 N

Actually I'm starting to find the whole Elian saga more interesting now. I too was sick of it for a bit but now it's starting to get more and more interesting. Have I gone crazy? Maybe but I don't think so. What could possibly be interesting about this "dead-horse" story? Well the religious angle is fascinating. On MSNBC they were saying that alot of the cuban exiles see Elian as a Moses figure and now sitings of the Virgin Mary are appearing all over Miami. It was even reported that Elian himself believes he sees her from time to time now. Plus it'll be interesting to see how the government handles extricating the kid with the shadow of Waco hanging over them.

18:01 mega

Sick of Elian! Sick sick sick and tired. If we had real leadership in this country, someone important would have made a decision before he even left the custody of the Coast Guard or whoever picked him up Thanksgiving weekend. Instead, the leadership vacuum is filled by Cuban exiles, who are more than happy to shape the country's foreign policy. Where's the Power Elite in this situation- unless they want this situation to drag on forever? I have a theory. I think that the Power Elite is stuck over Cuba (as stuck as they can ever be). They've made a shitload of money off of the Communist threat (which they created and sustained and demonized) and so committed to the Isolate Cuba policy. But now, the Cold War is over, and the threat of Cuba doesn't pay the bills anymore- not like taking it over by pouring in American trade and culture would- but they can't do that because of the Isolate Cuba policy. Just a theory. Polls say that Americans are creeping towards wanting an end to the boycott policy, talking heads are starting to spew in favor of it, saying that Castro would never have lasted this long if we had trade, the PR campaign is well under way... In fact, this Elian debacle may even turn the country more pro-trade with Cuba, as the Miami exiles make fools of themselves trying to run things. Now the Elite plan is clear... the Mafia will be running Havana again in no time.

The thing is both record companies and motion picture companies do the same thing when they feel threatened. They circle their wagons and then they raise prices once they win anything. What they never seem to get is if you offer decent content for a good price people will buy it and they will end up making more money. Look at the Titanic DVD. The company that released that added virtually no extras and charged a fairly high sell through price of $29.99. It didn't sell even close to what they expected for the biggest movie of all time. Then the Matrix came out a few weeks later and it went gangbusters. A quality package with lots of extras and a decent price (MSR 24.99). People ate it up. Highest selling DVD ever up till now and the Sixth Sense (another fairly priced DVD with oodles of extras). It's ironic to think that back in the 80s the MP industry actually tried to stop the sale of VCRs because they were afraid it would destroy them and now the same industry relies on the videotape revenue to survive. Will they never learn to embrace new technology?

14:41 mega

Record companies are evil. They charge us 16.99 for a CD that costs them 4 cents to make: 2 cents of materials and manufacturing and 2 cents to the artist. They should burn- but I'm not hopeful. I still cling to the small chance that the Information/Internet Age will lead to a glimpse of the kind of freedom, say, that the replicators on Star Trek would. What's more likely is that the I/I Age is ultimately only going to hand the Power Elite a sweet opportunity to revamp the property laws more to their favor. The Motion Picture people want to make it illegal to merely LINK to that DVD-breaking code on one's website. There's a few major court battles in the works that could shape the entire landscape- and we all know what big money usually gets one in court: victory.

Man I hope Napster wins this. I can see the artist and the industries position but bottomline is those that are using Napster to avoid buying album probably wouldn't buy the album anyways. Any music lover will support their favorite band. The only musicians I can really see suffering are the one hit wonder bands. No more buying an album and finding out the rest of it sucks (sorry Hootie's of the world). And it's hard for me to feel too sorry for the industry when they are increasing the price of CDs even though the cost to manufacture has fallen to the point of almost being negligible. Notice that most major releases over the holidays were a dollar or two more? That was no accident. It's the industry seeing if the albums will sell with the higher price. Makes me sick.

I was always under the impression that all movies made it at least to video. I mean if films like make it then surely a film by the director of Out of Sight would too, right? Not so. After watching The Limey I decided that I wanted to see all of Steven Soderbergh's films. Well all the ones that had decent reviews (which is all of them according to IMDB). It's 2:30 AM, and I couldn't fall back asleep easily, so I turn on the television. To my delight, the ST:TNG episode "Perfect Mate" is on! 2. A counter means nothing to me so as long as it doesn't mess things up you guys fight it out. Personally I feel having a counter either adds pressure if there are alot of hits or creates an environment where you don't want to post because there are so few hits. That's just my opinion though...

Item 1: Publishing after each posting item so the time/name stamp appears is good. But please post first!- so one can check for spelling errors and bad links. We don't want to publish 10,000 times and clog the Blogger list fixing things.

Item 2: Chris: Mega and I may need your FTP password at Geocities. Sometimes Blogger asks me for it. It shouldn't though, that's not right for those who want a community blog with one in control. No biggie: posting to save in Blogger, then logging out, then back in, then publishing, gets past the prob. Seems like a timing out issue.

12:38 N

I would say that we are close to going "live." As in: posting our UConn comic book computer game content for a week to see how it goes, then going public on Blogger, then submitting to Eatonweb Blog Portal, maybe the webrings. As in: I know there's a lot more we could do with the design, it definitely looks no frills (maybe we should say somewhere that we acknowledge it is no-frills?- or is it that obvious?), but what will we do? We could tinker forever at this point. We should have a subtitle of, "Hoping the content overrides the design." Ha. One issue though is archiving. If it goes as suspected, we'll accumulate a lot of content fast, and we don't want the page too long as Mega said (or was it Chris?). One last point: I really don't mind if it's our big personal chat room just for us. It's just that kind of attitude that will make it work if it has a chance to work.
